NYC Court May Open Door for Wild Horse Release

Judge to Render Ruling Tomorrow, Oct 21, 2010

Today, lead counsel Bruce Wagman, of the Schiff Hardin law firm, reported that the TRO hearing for the Habitat for Horses, ASPCA, Cloud Foundation, Toni and Dr. Don Moore suit against the BLM for rounding up wild horses in the Colorado North Piceance area has netted several positive results for both the horses and the American public.

“Of primary importance is the issue of venue has been ruled upon”, stated Wagman, “In the eyes of the court the ASPCA does have standing with these horses and the case will remain in New York”.  Last week the BLM attempted to persuade the court to move the case to a more BLM “friendly” western state or to Washington D.C. This request has now been withdrawn by the federal government.

Wagman went on to report that the court also found that plaintiff Dr. Don Moore has suffered irreparable harm by removing said horses who he has personally known for decades.  The BLM stated that Dr. Moore could just go elsewhere to see wild horses and the court agreed that such an option was not suitable or appropriate.

Still remaining to be decided is the main point of law, argued by the plaintiffs, that the BLM has not proven that the horses are indeed “excess”.  The law suit states that the BLM is in violation of the Data Quality Act and does not use contemporary and updated information in deciding how many horses should be removed from public lands and which herds should actually be “zeroed” out.

The judge intends to make his ruling, tomorrow, October 21st 2010.  If in favor of the horses the captured equines will be returned to the range and the helicopter stampede will be concluded.  If not, the BLM will continue to conduct their ill conceived stampede and additional wild horses will be added to the 40,000+ confined animals that the BLM holds in concentration camps across the U.S..

    • Please set up a Freedom Fund for the Older Gray Stallion Carol Walker documented that fought bravely against the round up contractors and gave everything he had. Every ounce of stamina and courage. He needs to be saved from longterm holding.

      • With all due respect, particularly under this news, our great legal team does need to eat and we need to endeavor to fund our suits to STOP the roundups once and for all. We are attacking the illness and not the symptom. Any help would be greatly appreciated as the BLM has deep pockets and we do not.

      • Right now I am doing this on my own..I have no idea of how this process will unfold, I am hoping to build a blueprint so we can do this, or an individual knows the process..I know what adoption fees are but the rest of it I will know as it unfolds..hoping to get input from those involved in the aquisition of the calico stallions and mares..At this point i have 2 days in a row called Canon Colo facility to inform them I wish to adopt Gray Beard, the old gray stallion with bite marks and hoof prints on the left side of his kneck gave arrival time and told them I have pics, compliments of carols work, Carol has been very helpful..she found out the vet had examined him and he was alright..I will take that with a grain of salt as carol said they were not allowed to view horses up close themselves but she did see his pen, and his pen was being shipped not returned to HMA as a few are,,I twice left a message “I donot want him gelded”..carol maybe headed to the facility after the round up and could identify him..but they may geld in the meantime..i have yet to receive a call back from 2 calls but will stay on it..If we had been organised-we could have saved the mare put down at Tonapah, watch the video at Lauras a few days ago…There was nothing wrong with this mare I named “Why”?? she would not load in the trailer, she was lame and in great shape, the BLM according to its ‘kill” protocols is not to kill an animal except if they would not survive in the wild, survive the haul or survive LTH..she was in great shape probably a 6, was not old and survived and kept up the long run to the gather pen..SHE was killed because she gave them a hard time loading period-who in the hell kills their horse because they give you a hard time loading ..some backwater cow vet thats who..whos job is not to protect the wild horses but to appease the BLM..thats who..club foot my A##

      • RT, we have many babies to feed in this quest, we will not let 1 baby starve and die to feed another..We will find a way to feed them all, as you well know, there are people who will not donate to legal fights that will donate to save some of those at immediate risk of death,,these are the horses at gather sites who will not survive..we need to adopt immediately..Or stallions like grey beard who are too frickin old to face gelding with only a few years left..and need to go to a “wild and free” sanctuary to live out their days with a young chick like grey beard had…You would want me to adopt you ASAP-if someone was going to geld you…

Let’s hope they are all charged for what they have done to these magnificent animals. Unfortunately, we can’t bring back all the foals, mares, and stallions whose lives were taken, but hopefully, this will be the end to the mistreatment of such a legacy of ours, that future generations will be able to see these beautiful animals, and how fortunate we have been to have them grace our lives with all they have done for us. .

  7. Dear God above, we are praying that the court rules in favor of your beautiful wild horses! My family, will, indeed say a special prayer for the wild ones tonight. Please, continue to keep us all updated on the news & ruling. Maybe, this could be a start in the right direction, for all our precious wild horses. They need to be seen for what they are, &, for what they represent. These wild ones are our heritage, our national treasures, they ARE spirit, will, determination, &, FREEDOM!!   8. Oh how wonderful. It seems that in the case of Dr Moore the judge sees that these horses are individual beings that matter, not just a nuisance species to be controlled in some manner. With this kind of ruling we must be getting closer to stopping the cruelty.

The only people that are not listening is the BLM. They have been on a rouge campaign against all of us fighting for our rights to restore the mustangs & burros to their RIGHTFUL HOME. IT IS OUR LAND & THEY ARE OUR HORSES & BURROS. This should have never happened & now I hope the whole world will stand up & look at the BLM for what they really are…money hungry non-law abiding arm of government that thinks they can do & say whatever without any accountability!   15. My own thoughts are with Cloud right now. Its dark and winter is coming quickly to his mountain home. Mares have their kids nearby, some are nursing and others are playing til they’ll called home to bed.

    Youngsters play in the trees and out in the open. Moms are busy eating both for the youngster at foot and possibly for the one to come in the spring.

    At the helm is Cloud or another band stallion. Watching carefully over his domain and making sure all is at it should be.

    Cloud grabbed my heart last year from the first picture I saw of him. It’s his, hook line and sinker. He was the reason I went to the Pryors this summer. And he remains the reason I stay in this battle for not just his freedom but for all his cousins.

    When a wild horse will pass within feet of you and not try to bite or charge you–there telling you something. There telling you that for the moment you are someone that they trust for this brief period. It’s a totally exhilerating feeling. And to know that I’m trying to help Cloud’s cousins is awfully empowering. I may never hear Cloud say “thank you” in human but the next time I go to the Pryors and he allows me fairly close without getting upset–I’ll know he’s saying “thank you” in horse. Most of the time I don’t understand foreign languages but horse is one I do.

    So Cloud to you I raise a big glass of ice water with my dinner in your honor. Thank you for helping me learn what this fight is all about. You are a great leader.

    • hello I just don’t understand why our Gov. doesn’t create an Eco Sanctuary for the Mustangs with viewing of the mustangs and possible rides thru the woods; plains or deserts on backs of Mustangs; why does our Gov. take a valuable resouce and wreck ?

  16. Judges, like the general public, need to be educated on the issues that come before them. Each case is another opportunity to educate. This is what we see happeneing right now. Its just a crack of light coming thorough, buts its light none the less. A big step forward on many fronts, including standing which has always been the bug-a-boo.

    Hope the judge lets the full light of day shine tomorrow.

    I’M IN LAW SCHOOL AND SO BUSY. BUT ONE OF THE FIRST THINGS I DID WAS GO RIGHT DIRECTLY TO THREE SITES PRO ANIMAL RIGHTS.
    CAME ACROSS THIS BY LUCK, HOURS OF SEARCHING, NOT EVEN HAVING DINNER YET.     Also, do you know how many horses will be returned to the wild if the ruling is in the horses’ favor? How many from this particular ruling, I mean, and not what might happen in the future using this ruling as precedent? Thank. EN

  20. While we wait for someone with the power- to open the gates of morality and do the right thing for the wild horses.

    Can experienced horse people take a look at the internet adoption horses the blm has up on their website.

    The BLM hardly ever has horses they are trying to adopt for throw away prices looking the best, but this group has some concerns.
    The fencing in the background is the stupid cheap impalier steel posts with barbed wire. The blm requires adoptors have a proper fence, yet their small corrals pictured are dangerous.

    In addition take a look at the hooves on several of the horses offered. They are listed as being in BLM care for years many of them, yet at the ‘about’ 6 month mark of hoof regrowth, there are what look like founder, sickness or neglect rings on several of the hooves.
    I think all the horses the blm wants to adopt should have much better care and at the least be started on halter training, leading and used to loading on trailers.
    Someone needs to help the BLM adopton management and show them what a quality contract is, one that really helps keep the horse safe, for life.

    • Looked at the all the Burns horses yesterday. Piney Woods wasn’t up yet, but I looked at them this morning. Rings … flares … WHO CARES? Long toes … WHO KNOWS? If they’re adopted, they become someone elses problem. I just pray the adopters find good natural balance farriers who won’t try to “fix” everything with a single trim. Otherwise, they’ll end up with soundness issues, abcesses, or worse.

      With prices so low, I always wonder what’s in store for adopted horses. The mustangs may be “cheap”, but no horse is “cheap to keep”. I imagine lots of them get minimal care at best.

      I LOVE the left-hand photo on the “Adoption Information” page. Happy horse, happy owner. Nice big metal stall and tall pipe panels. Just what the BLM requires. So what’s up with the t-poles and the wire mesh at Piney Woods? Good for the goose, but not for the gander!!!

      • Linda — I worry about these horses’ feet, too. I’ve seen more horses ruined by improper hoof care — neglect, bad trims, ignorant farriers — than almost any other cause. Whole horse care has so much to do with balanced feet.
        Add stress and dietary changes to the mix, and it’s a wonder any of these captive horses make it out alive.

  21. while we pray for the wild ones, here is ANOTHER blm adoted mare, FREEZE BRANDED and a url below!! that is now sitting in a known kill-jobbers lot. AC4H is listing her trying to get some generous person to get her out of there!! before it’s to late. If noone buys her, Heres yet another BLM horse, they slowly with the crappy adoption insure may end up dead-slaughtered. Or even worse, get sent to mexico and be tripped or tortured to a slow death.

  22. Laura — I’ve sent donations to this group in the past. Very nice folks who work VERY hard to keep equines from going to slaughter. I have no extra cash to send them at this point, as I’m un-employeed — but I’m putting out my prayers for her — and I really appreciate that you posted this. Thank you.
    This particular mare is only 4-years-old. I watched the video. She looks a little unsure of what’s being expected of her, but seems interested in trying to do her best and doesn’t appear people-shy. This is the perfect age, IMO, to polish her ground work and start working her under saddle, if she hasn’t already been started. She seems sound and has a sturdy build, with a great heart, by the look of her!!

      I have been upset ever since I saw her on the web. I think she is listed for 650.00 way more than an adoption price and I hate the fact that the broker who hauls horses to slaughter is getting top dollar for her. Needless to say if 10 people could donate $65.00 each (Plus coggins-fees) and find a rescue for her she could be saved. She appears to be in good shape and is only 4 years old. She is located in Pennsylvania where this creepy broker does his business. Anybody out there with a rescue willing to take her? Anybody willing to donate?

      • If we can get 10 or more people right here to pledge and someone can find a rescue to take her then we can send the money. But we need a person there…. a contact who can handle money and getting the mare moved to rescue. Is there time to do this?? mar

        my mare who is now 15, was captured as a 2 yr old in nevada, adopted out by the BLM.

        At 12 yrs of age she was in a low price horse auction only other bidder was a kill jobber.

        shes safe now forever, I can’t stand it when the blm has such a piss poor adoption program and seems to throw wild horses towards the slaughter pipeline as fast as they can.

  23. Yes, Louie I watched it, I have sen it many , many times and each time its just keeps getting better !!!!! What an inspiration it is………………How I know we all long for the end of the Movie !!!! I cry with joy everytime I see it !!!!!! Last nite there was no sleep over here , Praying all Nite that the Judge will be fair and honest and caring , and give the only ruling that is right here !!!! I am a nervous wreck over here , waiting is the worst thing, I just keep praying for what we all want to hear !!!!!! Had to go this morning and see my friends race horses, talked to them for quite awhile, they are so loving , my friend loves each one of them !!!! they love to kiss you , and nuzzle you , and of course they love the peppermints in my pocket also……..I found some peace with them this morning !!! They also knew I was tense and gave to me their undivided attention, as i thought they almost know what is going on……….. They were extremely loving today !!!! I told all 3 of them not to worry we are all working on it……………………………………And today just might be the day for truth and Justice to prevail, as I left them they all whinnyed just like they knew what i just told them……….

A review of those proposed policies revealed a perpetuation of the same “management-by-removal” approach that the BLM has been following, much to the detriment of the wild horses and burros.

    I must admit I have a couple of serious issues with the Prison Program.

    First, they ride some of these horses WAY too early. Doesn’t matter how sturdy they look, their bones don’t “set” until at least 4. “Quick” (2-year-old from Calico) was adopted for $8,500 (!?!). I hope the folks who adopted him home know enough to KEEP OFF and do groundwork, maybe with a light racing saddle and NO rider, for a couple of years. Granted, he’ll regress a bit, but it, in the long run, it’ll be worth it to keep him healthy and sound.

    And since the BLM continues to take the babies and yearlings (which they should STOP doing – I put that in all my comments), at least train them ( at prisons or wherever) to the point where they’re handleable. I the photo(s) they should be bathed, groomed, in a halter and with a person. Make them attractive to adopters and I think many more would find good homes.

    Anyway, some good news to read while we’re biting our nails!
