BLM Thinks It Has Won, in Reality They Have Lost

The Ground Swell of Public Support to Save our Wild Horses and Burros is Growing

On Tuesday, of this week, the honorable Judge Collyer heard our collective plea to stop the alleged “Emergency” roundup of a portion of the fragile and very special West Douglas herd of Northwest Colorado.  The judge has been a champion of these horses over the years and she was no less when she based her decision to allow the roundup to proceed upon the incessant and inaccurate claims of no water, no forage and eminent  death put forward by the BLM.  She was concerned about the horses yet we private citizens knew the BLM and their intervenors were less than truthful and that there is a much more sinister and deadly agenda swimming not very deep under the surface of those mucky BLM waters.

Over the years Colorado Wild Horse and Burro Coalition, Cloud Foundation, Front Range Equine Rescue, Habitat for Horses, Dr. Don and Toni Moore along with the Wild Horse Freedom Federation and hundreds of wild horse advocates have been successful at keeping the BLM from fulfilling their very public desire of “Zeroing Out” the 125 horse wild horse herd that resides in the West Douglas area.  We  collectively suffered a grievous wound on Tuesday with the horses feeling the pain and experiencing all of the heart wrenching trauma, as usual.

I am coping with processing this blow, admittedly it has thrown me a tad off balance.  Not so much over the human feeling of disappointment but instead from the deep rooted fear and feeling of eminent panic that the horses are about to feel as they are terrorized into capture where their families will be ripped asunder and they will never be allowed to live their natural lives, in bands of families, again.  I feel the horror of war with the horses being the innocent victims as the BLM roars through the west ripping apart protected and natural tribes of sentient, gentle beings who wish nothing more than to be left alone where they can simply live out their lives with their families while disturbing no one or nothing in the process.  It appears that as humans we learn very little from history.

By rounding up 50 out of an estimated 125 horses from this herd the BLM will successfully render this equine community genetically unviable, as they have so many other herds, which will further their unsubstantiated excuse to come back and wipe out the horses leaving only a silent and forever dark hole on a landscape that was once rich with the life and energy of the great, American wild horse.

I have to tell you that my heart hurts, my stomach churns and my fists are clenched; not the physical characteristics of a coward but instead one of a warrior whose passion to save the innocent and protect the word of the law with all of the faculties that the good Lord gave him are aroused.  We may not have won this skirmish but we are by no means out of this war and I will tell you why.

Firstly, we are lead on this legal fight by one of the best animal law attorneys in the free world, Bruce Wagman.  He is of such a high caliber that it was actually quite difficult to acquire his services as he is in high demand speaking on behalf of not only the horses but elephants, chimpanzees and many other non-human beings that are set upon by the cruel and inhumane practices of humankind.  Google Bruce and you will also find that he is a published author and contributes articles to a multitude of honorable publications.  Bruce is not only a true champion to the cause of protecting those who cannot speak for themselves but is also an ambassador of the human race to the other species on this earth that share this planet with mankind.

Secondly, the public stepped up to the plate on this one, big time.  A plea was issued for help in financing this defense for the horses and the call was heard, with spades.  A legal attempt to block the actions of the rogue BLM and their special interest groups can get into 5 digits pretty quickly and many folks dug deep and became active members in this case and gave a great fight for the sake of the horses.

Thirdly, those who brought this case to court and the leadership of WHFF are not giving up, instead this fight has only managed to further their convictions and harden our resolve to pick up the pace in this fight and to not only attempt to strategically block the premeditated efforts of the BLM to eradicate wild horses from our public lands but instead to further fine tune our efforts to tactically attack the BLM where we know they are violating the intent of the law and ensure that they are put into a legal tailspin where the roundups are stopped and we can approach this issue with cool resolve and science on our side.  We are NOT going away.

The leadership of WHFF is SO very motivated to make a difference and to shine a public spotlight on the plight of our wild horses and burros that that the Board of Directors will, in September, make an in person trip to D.C. to deliver, to date, over 5,000 letters from the public crying out to the President of the United States to put a STOP to these senseless and expensive roundups once and for all.  This excursion will be financed, exclusively, by the separate volunteer members of the BoD in an effort to display the transparency and dedication that the leadership holds close to their heart on the issue of the managed extinction of our wild equines.

We have been deliberately closed lip about the collection of these letters as there once was a past attempt to do the same but this effort will not fail nor will it be put on the back burner, the Wild Horse Freedom Federation is going to the White House.  With the Presidential election only weeks away, perhaps we can garner a nod from the individual who currently holds the reins of this great country.

This weekend we will launch a online form where you too can add your personal note and appeal for the cessation of this cruel nonsense and I assure you that Terry and myself, at the very least, will personally carry your message to the President of the United States.  We will hand personally deliver your message, full stop!

The BLM did not win on Tuesday, they only fueled the fire to push us forward.  Keep the faith, my friends, we are taking this fight to the source.

The light will never succumb to darkness.

      I know what I sent Ginger for the legal fund was well spent and hopefully there was even some left over from everybody’s donations to help with more actions.

    • Please let me know where I can send a letter. We adopted a mustang from the CO BLM because he was orphaned at 2 months and at 4 months old none of the three colts that were orphaned were doing well. They all were very sick with blood worms, ring worm and insufficient weight gain. The BLM wanted to save them, at least, which is why they gave them to us, but their family should never have been broken up to begin with. We named our mustang Courage, because he is a survivor. He was born on the compound here in CO, from a mare that came all the way from Oregon. Why does the BLM continue to decimate the herds? We want it to stop.

The horses belong to the people of the USA–they do not belong to BLM–whose mandate is to manage them on the range lands as an integral part of the environment.   4. Thank you, RT – we all have taken a hit with the ruling from Judge Collyer, but we are not done for. With your continual leadership (especially when you get the pompoms going! LOL) we just gather ourselves up, dust off our butts, hug each other through this site, and go on. All of us, including you, are allowed to take a hit like yesterday and give ourselves time to process, examine, and regroup as needed. Don’t think any of us have any thoughts of giving up or quitting. We all signed up for the long haul. What has often sustained me through the last 2 years was a comment from a friend on the phone one day = I was close to tears while telling her about what the BLM was continuing to do in spite of best efforts at that time, and I said, “There are days when I feel like I’m standing out there in a 100 mph wind trying to keep my candle lit!” There was dead silence for a minute on the phone and then she said (with a loving chuckle to her voice), “Well, honey, THAT’S WHAT LIGHT WORKERS DO!!” Just know that you have the MUSTANG ARMY (rather than Dumbledore’s Army LOL) beside and behind you at all times. Blesssed Be.

    • Channel 4 Denver just showed the West Douglas horses who may be removed. They said 40 of 150 were outside their HMA and there was very little water. They showed a seep that was running water 10 times better than the seeps the Spring Creek Basin herd has been drinking from in a much drier area in Southern Colorado. The horses have been drinking from the seep and a lower trough but another trough placed on higher ground they avoid. The horses were seen in the pines and they all looked good, including foals. They also mentioned the lawsuit to keep them there in the last sentence.

      Spring Creek Basin has been improving their seeps this year. This is near the Disappointment Valley South of Montrose and North of Cortez. West Douglas could have used that, too.

      I am sure this will be on video tonight and also shown on the later news edition.

Why can’t ALL Organizations, like HSUS, like PETA, [ too many to name,] Inform ALL their activis’s, ALL their members, about what is going on , what is done to the Wild Horses, Horses, who are a part of the American History, Horses, who belong to the American People.. Horses, who belong to Themself’s and their families. Horses who are living on the land, GIVEN to them. ..   6. My first and foremost comment is “there is no excess of wild horses”.

    This $40 million dollar BLM public relations proposal is just another cover-up for the illegal abuse of our wild ones but it’s interesting to note that they can designate millions of dollars for this project (which includes keeping a data base of caring advocates but where is the data base for our WH&B!!!) but they can’t take some hay and water to the range for the wild ones who have had their forage and water stolen by livestock and other BLM “give-aways”.

    • Yes, GG, it seems they want to offer the public some gentled and trained wild horses which is good. But, this looks like a huge undertaking to funnel more wild horses away from their homes. If we/they are about to lose their lands out from under them we need to stand up to this, too. Why wasn’t this money found long ago when BLM began to pull so many off the range??? They were hoping to do it with out being noticed or challenged. Those who have been born in captivity need this. Younger horses for sure. But this is another PR project to keep wild horses flowing away from their lands.

I informed them of the huge number of advocates involved with saving horses from slaughter and the BLM wild horse and burro issues. I told them turning a blind eye will not make it go away and election is coming up. Anyway, for what it is worth?

Spoken like a true warrior R.T.!; set-backs like this only strengthen the resolve of fighters who do not resort to violence but instead push forward with persistence, intelligence, honesty, love and courage. Yes, it really infuriates me when the wild horses and burros rights, and our rights as American citizens, gets stomped on and disregarded……however, as I have experienced in training horses successfully for over 40 years (began training horses when I was 12), and what the HORSES have taught me more than any human ever could, is that patience, persistence, problem-solving, and LOVE (believe it or not–even when a horse is difficult and/or dangerous, I learned that loving them and helping them over-come their issues turned the tide EVERY, SINGLE TIME in our relationship) WILL win-out in any battle, EVERY TIME.
    None of us are going away, no matter how much the BLM throws at us, we also aren’t going away because private business interest factions want to take the Open Range, the horses and burros lawful land, for their own to do with as they please. Not only does our side have intellect, common sense, people from every walk of life with their own key abilities (lawyers, biologists, behaviorists, wild life experts, and on and on), etc, on our side, our side has something none of these other entities/factions have; we have passion and love for the wild horses and burros that fuels us the most, so we ultimately will win this war that seems like a constant uphill climb, as long as we never give up, no matter what.
    The horses and burros need us more than ever as our opposition is squirming and on-the-run because they can see the writing on the wall and thats why they are ramping up the captures; the same thing happened in the late-’60’s and right up until the protection act was written into law. Victory is in sight, so if we keep the pressure on, we will win on behalf of the horses and burros.

Because, as you say, the handwriting is on the wall and it’s writ large enough that even those that are blind to the law and the suffering of our horses can read it well.

  10. Why can’t the BLM release the horses once the drought is lessened? Or was just the excuse for rounding up and zeroing out yet another herd? If that was what is behind all the cow manure screwed then I think Judge Collyer needs to be visited again!

    And for the past several years she has found for these horses so let’s not just too off track by the finding. Rather let’s use it to find a way for these horses to return home. Precedent was set with Traveler, so BLM can do it again.

    • What!!?? Help RT and WHFF and this suit, here, please!! There is no connection or obligation to those people!! They left. This fight for West Douglas has been on going for 3 years, I believe. It has been the most successful of all the lawsuits. This is the issue and this suit needs our help, here and now!!

    • Should Laura prevail in her suit against the government, Mr. Cownan will be eligible for a percentage of his fees to be paid by the government (which of course, is our tax dollars), but until and unless the Government Litigation Savings Act is passed, that is the way the law works.

      I trust that R.T., Terry, Ginger, and Hillary are aware of what our (per protecting the wild horses) needs are.

      We may have a few more cards to play here, and if we do, Bruce Wagaman should know what they are. I still have the article he wrote in the Journal of Ecology Law a couple of years ago that has led to the situation the wild horses and burros are in.

      This incident may add a couple of additional nails to the BLM’s coffin. Whether they destroy our wild horses and burros, before the citizens of this great country wake up and demand that this not only corrupt but scientifically ignorant organization be shut down before it squanders what is left of our natural resources. The Keystone cops should be allowed to play in the desert if they want, but tax payers should not be paying their salaries, health care, or retirement pensions while they are allowed to destroy the animals we love.

      There wouldn’t even be a BLM or an Interior if not for the Congressional mandate to protect the wild horses and burros, and since they seem deliberately and studiously incapable of doing so, it is only the proper Karmic, poetic, and justice their destruction of our wild horses and burros should lead to their own.

    • Margaret, the funds that came in were designated specifically for the West Douglas herd, by the donors, and were used strictly for that case. As Mar has indicated, this battle has been going on for a number of years and the bills are mounting. Unfortunately, not enough funds came in to completely cover the bills for West Douglas but we did put a nice dent in it. As for Mr. Cowan our current outstanding bill is really quite minimal so not sure where ‘a LOT of money’ came from. Of course, if you would like to contribute to that bill and help to pay it down, WHFF (and I’m sure, Mr. Cowan) would be very grateful. You can donate to the ‘Legal Fund’ and indicate Humane Case and those funds will go directly to that bill.

    We who have lived here in Beatty, Nye County, for some time have for the most part been proud to have burros as “not quite pets” but “more than wild animals” as part of our community.
    Along comes BLM in 2007 and against the wishes of the majority of citizens of Beatty, rounded up and disposed of burros. No more would they be wandering down Main Street, 14 strong, to remind us of the beauty of desert animals found in this area.
    I have never had a problem with burros. They have come to my fence and clipped the grass, which grows under the edge of the fence. When we inquired why BLM felt it necessary to do a round-up in spite of overwhelming written response asking that they be left alone, BLM stated that it is the “law” that they must respond to the request of a town board or local government agency if a round-up request is made.

    Now we are looking at another round-up BLM claims is necessary, and they’re not saying special people are asking for it this time.
    Two of the local burros are special to the folks here and are commonly called “Beka” and “Echo.” We would like them to be left alone but BLM indicates the way this can be accomplished is to have them legally adopted by someone.
    Folks in Pahrump became aware of this and volunteered to adopt, saying they had a 40 foot by 100 foot corral suitable, and only one burro currently in it who is lonely. When we spoke to them, they were very interested in adopting Beka and Echo until it became clear that they would be forced to do it through dealing with BLM. They stated that they wanted absolutely nothing to do with BLM or their invasive, nosy, busy-body intrusions into the private lives of citizens.
    I concur.

    It is a shame that these burros will probably be rounded up and disposed of along with a lot of others whose only crime is to be doing what they have every right to do — live in peace and forage on desert land owned by the citizens of the United States, but unfortunately administered by BLM. These Nazis will not allow citizens to feed the burros and adoption is hampered by the public’s opinion of BLM and its employees.
    Now I consider the BLM to be as toxic to myself and my fellows as Senator Reid and Senator Heller. These folks do not represent me or most of the people I deal with. Laws being enforced in Nye County do not reflect what I feel should be dealt with by the government.
    Special people get drunk and assault others without penalty; could it be because the district attorneys, lawyers, judges and cops all drink?

    The way BLM treats burros reflects the lack of respect public officials in general show citizens who are not part of some “club”. Shame on you, Nye County. Shame on Nevada for having Senators like these and shame on America for becoming a police state disregarding the will of the citizens.

  18. I just visited a link from the PPJ Gazette to Ormat. I noticed that all of Ormat’s projects are in the West on public lands.

    It seems like a carefully managed, gradual, tiered sale of public lands to private owners—not necessarily to corporate owners but not necessarily to exclude all corporate owners, might give the people who live in these states more control how the land in and near their homes is used. Private property owners, not those leasing grazing space, would be better stewards.

    Wild horses and burros should be allowed to remain in their herd management areas, but managed by a special agency dedicated to their health and preservation.

    Imagine what Colorado, Nevada, California, and other states would look like if you get the BLM our of the states for good and let private citizens own the land as they do in the other 40 states. Essentially, the most corrupt and incompetent agency in American history is managing the natural resources of 1/3 of the country. The only reason this level of gross mismanagement goes on is that so much of the area is unpopulated, and therefore, unobserved. Not that there are not corrupt businesses or government agencies elsewhere, but where there are people there is scrutiny.

Why can we not contact ALL the Organizations, so they can inform all their activist’s and members, ” to get involved, NOW,”!!!, by “writing letters, making phone calls , sending Faxes, to the Judges, to the White- House, to Congress, to have demonstrations, It should be talked about on ‘Date Line, on 60 minutes. etc. It should be talked about on the radio, So far, only ” Jane Velez Mitchell ” has talked about it on her TV Show. What about “Ellen de Generes”?? There are so many people in this country, they have no idea, what is going on. What the BLM is doing with the Wild Horses, The Horses, who belong to the American People.. What can WE do?!!! I am crying for the Horses, but that doesn’t help them!!!

  25. I am so disappointed by Judge Collyer’s decision but certainly commend RT on his valiant comeback. BLM is dead wrong in how it is treating this small and harmonious remnant of wild horses in the West Douglas HMA of Colorado. This is a BLM state that has zeroed out over half of the original 1971 legal acreages for the wild horses. It is clear that their agenda is both illegal and malicious and that they do not serve the General Public but rather certain fatcat greedy interests bent on squeezing the public lands regardless of the ecological health and benign restoration and healing that is made possible by the wild horses, who by the way are great fire preventers as post gastric digesters, as I explain and prove in my book The Wild Horse Conspiracy, which I hope you will seriously read soon.

  26. I was up there today where the West Douglas horses are. I also hiked in that area about two weeks ago and saw plenty of seeps and springs. It rained constantly for about 15-20 minutes while I was up there today. And more rain is in the forecast. BLM has no reason to remove these horses. The horses I have seen in the last two weeks on Texas Mountain appeared to be very healthy. I have spent a lot of time up there observing and photographing these wonderful animals while they graze.
    I have been watching West Douglas horses for many years. My friends and family from out of town love to see them. What a shame! I can’t believe that little foal won’t be running around her mom, playing and jumping around after this roundup. This is such a sad time for our horses. BLM is an agency out of control. It really isn’t our land anymore. It is theirs. So BLM, why don’t you change your signs to say, “These lands belong to BLM, not the people of America.”

    • Right on, Penelope! Way to get out there and disprove the biased claims and whitewashes of BLM Colorado that are so ill-willed toward the wild horses and their freedom and based on their own dishonorable agenda!
