Greedy welfare ranchers dictating public land use…Wyoming wild horse roundups to begin

Appellate Court Denies Emergency Motion and Allows Unprecedented Wyoming Wild Horse Roundups On Public Lands At the Request of Private Landowners

Denver, CO (September 10, 2014) – Today the U.S. Court of Appeals for the Tenth Circuit denied an emergency motion to block the Bureau of Land Management”s (BLM) wild horse roundup in the Wyoming Checkerboard. The motion was filed by the American Wild Horse Preservation Campaign (AWHPC), The Cloud Foundation, Return to Freedom and wild horse photographers Carol Walker and Kimerlee Curyl.

The one-sentence decision by the Tenth Circuit does not address any of BLM’s admitted violations of the Wild Horse Act and clears the way for the roundup of more than 800 wild horses from public and private lands in the Adobe Town, Salt Wells Creek and Great Divide Basin Herd Management Areas. The helicopter capture operation is scheduled to begin this week after being twice delayed by the lawsuit filed by the wild horse preservation groups and advocates on August 1, 2014.

    We have the written law and no one in authority abides by it

    The horses need a voice… someone that the media follows every move

    And I’ll say it again Pamela Anderson the actress, she is a big animal lover and advocate, PETA used her against the fur trade quite successful

    Contact Ms. Anderson and get her on board and watch things change in the horses favor

    Honest truth…if it wasn’t for WordPress I would not have a clue what’s going on with the wild horses

    • Here’s the ruling in its entirety. How can this NOT harm the public interest, first by illegal removals, then by making taxpayers pay for it (ad nauseum)?

      “Petitioners-Appellants have filed an emergency motion for injunction pending appeal. The party seeking such an injunction must address: (1) the likelihood that it will succeed on appeal; (2) the threat that it will be irreparably harmed without an injunction; (3) the absence of harm to the other parties if the injunction is granted; and (4) any risk of harm to the public interest. Homans v. City of Albuquerque, 264 F.3d 1240, 1243 (10th Cir. 2001) (per curiam). We conclude that Petitioners-Appellants have not shown that the balance of these factors favors granting the motion. Accordingly, the motion is denied.

We are a republic that elected people to represent us who in turn appoints Federal Judges.The Federal Judges in turn defeats the mandate of the people we elected by circumventing the law and thus the will of the people. The “Republic for Which it Stands With Liberty and Freedom for All” is hypocrisy, for the very living symbol of that freedom is being unjustly eradicated.

    • Louie, I agree this needs to go higher up the ladder. It seems we DO have a conflict of law (especially in the Checkerboard) on many levels; the sheer cost to taxpayers makes it important. I don’t know about any particular Justice’s interests but we do know Sandra Day O’Connor (retired) has some family experience managing wild horses so is at least aware of the complexities. Perhaps someone could contact her for advice on how to take this issue higher up while there are still wild horses reproducing in the wild?

      • Icy Mr. Day NEVER asked his sister for any help. He lost the contract because people within BLM wanted to take him a peg and his sister. They felt he had too much power. What they didn’t know was he never asked her for help.

        I’m not sure how helpful The Chief Justice could be today. I do know BLM hasn’t much changed since Mr. Day had his contract. Except to get even more sneaky, sly and underhanded.

  7. I’m trying to think how we finally got one win against a govt agency. I think we finally got an honest judge who may have actually read some of the material we presented, besides having a good smart young gung-ho idealistic environmental lawyerand maybe also we had finally gotten a boatload of public access papers we requested, that showed the internal workings that were not good , like memorandums and communications and such. But still, stuff is going on, of course.

  8. Does it seem to everyone that our cries..our petitions are & have always been falling on deaf ears! I cry thinking of all the wild mustangs that uve captured..seeing them lose their freedom & being put in dry,barren,pens without protection from the severe extreme sun & driving rains, & freezing bitter winter storms with snow so deep u can barely see the horses because they’re burried..some frozen alive. All you cattemen & all of the BLM…I hope you all rot in hell…Karma will get u all ..& I can’t wait!

  9. Has anyone thought of making protection against the elements in all the corralls? I know there was talk earlier this year..even last year..but they are going 2 need it more than ever b4 because of this years forcast. It is going to be one of the worst snowy winters in history. This is a must do…winter is not far off. I hate the BLM & All they stand 4…& that goes 4 all cattle ranchers too!

  10. The way I’ve understood taking something to the Supreme Court is this. You don’t go until you know for certain you can win. Why? We will get one chance at this. If we go early and the Courts have not been favoring us–most likely we will lose and the horses will too. There won’t be any more room for an appeal. It’s a make it or break it kind of deal.

    I don’t understand all the complexities and the ruling certainly didn’t deal with the EA and NEPA lapses. That portion is still being fought in Court. But it’ll be too late for the horses. The Courts will find the argument moot. We have to be ready to tell the Courts it ISNT moot. BLM is violating the law and should be held accountable.

    I’m also concerned as to where BLM plans on moving all these horses too. They have the 11-1500 horses out at Gunnison they need to place by Oct 6. That in itself won’t be easy. Now they have room for 800 more.

    SLAUGHTER IS NOT AN OPTION. I don’t care how panicked BLM GETS. Slaughter is not and will never be an acceptable course of action because BLM is overloaded with horses.

    They could make some room by releasing the donkeys back to zeroed out HMA’s. They could return the Calico horses back to their lands. The Calico Complex is now Tri State Complex or some such. Horses move on and off one part of the HMA and into another constantly. They took all the horses from Calico.

  11. This doesn’t surprise me at all. DOI isn’t going to stop it or them…hell, THEY CONFIRMED HER THEMSELVES! All she’s interested in is vacationing, hiking, bird watching and fishing. She doesn’t give a shit about horses, wild ordomestic.. This job for her is nothing more than a vacation. She chooses to believe the lies that are fed to her. Sadly,.SALLY JEWEL IS A JOKE.

    A decision that ignores and violates Federal Law, thereby allowing private interests to circumvent the Law and the will of the People is, under any definition, harmful to the Public.

I say it’s time to get PETA involved or even import some help from Ferguson, Mo (surely they understand).http://rap.genius.com/Prince-ea-why-i-think-this-world-should-end-lyrics Actually, I think before that maybe a class action law suit. I don’t know law and politics enough to know the next best step. I think maybe taking the job away from BLM due to “conflict of interest”, I think it should be given to those who have the best interests of the horses in mind. I think “conflict of interest” is a legal term that may have basis in law in this case. In the meantime, maybe we can appeal to higher intervention for an emergency stop, like Obama (and is the governor sympathetic, I can’t remember). It would be nice to know what our legal recourse is before having to resort to physically stopping something that is illegal anyway. Personally, I don’t consider that civil disobedience. It could be more like a citizen’s arrest of criminals. Or another idea is theft in the night of the horses. I just finished watching a western– they would probably just open the corral gate, at an opportune time– oops!

  15. This is pure evil and makes me sick for the horses. Should the round ups begin…..Who, YES, WHO will be at the roundups protesting and giving them a voice? 800 horses will forever be wiped out, losing their families and their freedom. Is anyone planning to go to the roundup sites and protest or stand up and protect our horses? The ranchers have us all over a barrel so to speak, when are we going to have the courage to stand up and fight for what we and the law says is right? Look what we did in the 60’s and 70’s, is everyone that afraid to standup for what is right? All we do is sit at our computers and try to get some big shot to speak for us. We can act too and show up at the round ups and do what we can to halt it. These are OUR HORSES AND OUR LAND!!!

  16. My Dad says to call our congressmen. I guess maybe they may be able to intervene in some emergency way?? Not sure. Although in the long term, they can do law changes. The law we have now is not being administered in truth. There is something in what my once seminar teacher just posted, although I know poiticians can help in important ways.

    Helena Winawa– I understand this to mean you have to take responsibility for your own life. Nobody else can possibly know what you want or need, only you. So, stop waiting for God or mom or your boss to do something to improve your life, only you can. You will see that once you start helping yourself and act, things will improve much faster and you will conquer obstacles you couldn’t dream of beating earlier. So be brave and do!

  19. Perhaps the judges know that the BLM doesn’t listen to judges anymore than it does to the Public.
    Even if they did issue a restraining order, it would more than likely be ignored.

    Having briefly scanned BLMs long list of arguments, reasons and legal citations regarding why they are authorized to decimate the West Douglas herds, I am still trying to pick my jaw up from the floor as I noticed BLM omitted one, tiny little significant fact about their authority to do so;

    A FEDERAL JUDGE TOLD BLM LAST YEAR IT WAS ILLEGAL!

    For those of you who may be unfamiliar with this case, Colorado Wild Horse and Burro Coalition, Inc., led by attorney Valerie Stanley had taken BLM to task regarding their authority to zero out the West Douglas herds.

I realize this isn’t a perfect comparison because these are privately owned horses and thus considered more valuable by some, but aren’t our wild horses “ours” in this same sense? Wyoming will this week lose 4 times as many horses as were led to safety here. Why?

    That’s right. Wyoming’s White Mountain and Little Colorado wild horse roundup party has just been cancelled due to a sold out show.

    The Removals, due to appear a week after the public comment period closed, denied the wild horses access to the event because there is no longer any space available in the overflowing containment centers now busting at the seams.

    With no more tickets for sale, BLM tried to negotiate a V.I.P. tour for the wild horses, which included backstage passes, food, drink, medical treatment and “party buses” to the arenas.

    Though disappointment was expressed that the wild horses were unable to attend the November festival, it is hoped space will become available by July 2008, when the Removals are next tentatively scheduled to appear.

    With such long-time favorites as, “Just One More Cow Please”, “Thriving Ecological Balance” “Riparian Rap”, “Givin Your Land Away” and the ever popular, “I’m Over AML”, the Removals earned overwhelming Congressional support that set them on a whirlwind tour in 2001, where over 70,000 wild horses and burros have since attended the shows.     Led by MCs Cook and Cattoor, the Removals provide a dazzling display of equine acrobatics as wild horses plunge down mountain sides, barrel through streams, and test their endurance to see which of them can outrun the hovering helicopters roaring over their heads.

    The Removals Tour is not without controversy however, with much of the public expressing outrage at the exorbitant prices the Ticket Masters are charging for wild horses and burros to attend.

    Initial cost range from $211 to $460 per capture ticket sold while daily expenses vary anywhere from $2.10 to $13.99 for each day a wild horse spends at the holding facilities after-party. (2)

    The annual cost of the Removals Tour has now reached almost $40 million (3) and fans argue the Livestock Tour only has to pay $1.35 per month for their cattle and sheep, so why is the cost of the Removals Tour so high? (continued)

  24. This just makes me sick! How can anybody be so heartless? I have devoted my life to saving people and can’t comprehend how anyone can be apart of this! Animals have fillings just like humans, they have families , children, brothers and sisters, moms and dads…they feel the pain when they are ripped apart! And then who knows what will happen next…slaughter most likely! What give anyone the right?

  26. This welfare ranching had got to stop!! What gives them the right to our public lands and destruction of our wildlife.
    There are already 60,000 wild horses in holding pens . The BLM surely knows that huge number can’t all be adipted?
    Probably 2% will..
    The Burns Amendment states that if there are too many horses to be adopted they can dispose of them
    And why hold them in pens for 3 years??
    They doing experiments on them
    They’re living in a concentration camp.
    They need shelter snd excercise. If they don’t die from disease or a broken spirit or heart first or not adopted ..it’s to the Slaughter they go.
    SOMETHING NEEDS TO BE DONE ASAP.
    I’m willing to do rallies. Go to the whitehouse.
    There’s really no reason in for .these roundups which break legs and separate families except to make welfare ranchers rich off the blood of our horses!

  27. Many Of These welfare ranching permits issued by the BLM are given to big cooperations that aren’t even ranchers at all

    The BLM also issues low cost permits to big businesses some from other countries under the pretense of a grazing permit . The states make little profit by these permits as welfare ranchers, business cos. Hold on to their permits so they can make deals later. These companies are making money by releasing grazing permits .

    Many of the businesses, welfare ranchers are convinced they own this public land as they get these permits so cheaply
    Also they are pretty much allowed to do what that want with this land and the wildlife on it. But We pay the taxes and they dont.
    So our current BLM today is more like a reality company. We need to get rid of our deceitful BLM…using our tax dollars to pay for the blood of our horses, wolves wildlife
