The Checkerboard Roundup 2017 is taking place right now and is expected to take 4-6 weeks. The BLM is removing 1560 adult horses and we don’t know how many foals from three wild horse areas: Adobe Town, Salt Wells Creek and Great Divide Basin. The total area of these three herds is 2.4 million acres.

This morning I drove out following the BLM and as we arrived at Bitter Creek Road, the fog moved in. We sat in our cars because it was bitterly cold and then we followed the contractor Cattoors and the BLM up to the trap site. We slipped and slid on the muddy mess the road had become and I worried if it rained we might get stuck trying to get out. When we arrived within view of the trap, we learned that the ideal spot to watch and photograph was on private land. Serena Baker, Public Information Officer insisted that they call John Hay the President of the Rock Springs Grazing Association and ask permission to have access to his land for observation. To my surprise and delight her agreed to let us be there. As we set up our cameras it began to rain. We covered ourselves and our cameras, and about half an hour later it began to clear. We heard the helicopter and he had a large group of horses.

As they got closer I saw a black stallion in front. As they approached the trap, they veered off. The helicopter came back, and the black stallion charged at it! He was so spirited. The Bay roan stallion behind him followed him. The group went over the hill, and then as they came down, he charged again! Then the whole group after one more attempt ran off, fast. The helicopter went to refuel and they added more jute to the wings of the trap. It was clear oto me that these horses have been rounded up too many times and they were not having it.

As another group came in a bay stallion broke away and watched he horses go into the trap. I wondered where his family was. Soon he was calling to the horses in the pen behind the trap. That answered my question. He ran around behind the trap, and we could see him watching the pen. We watched him, and when half his family was loaded onto a semi and drove out, he watched it and called to his mares. Then he would go around and call to his family members in the pens.

  1. If that brave stud had fingers he’d have given the chopper quite a salute!
    Think he’s a grullo though – see the mouse colored ears. Hardiest of all.

    Sickening to think most or all of these innocent animals in our care will disappear from view, and quickly it seems. Unless Americans wake up and stand up, and soon.

  2. If you truly believe Zinke is trouble and unqualified for the job he holds here may be a way to get rid of him

    Zinke’s traveling expenses are currently being investigated for excessive amounts of tax payers money he used

  3. Federal law cannot be violated under a consent decree. The BLM capture actions were implemented as part of a court-approved settlement of a lawsuit filed by the Rock Springs Grazing Association (RSGA), although the US Constitution states a court settlement cannot trump federal law.

    The Supremacy Clause of the United States Constitution (Article VI, Clause 2) establishes that the Constitution, federal laws made pursuant to it, and treaties made under its authority, constitute the supreme law of the land. The constitutional principle derived from the Supremacy Clause is Federal preemption. Preemption applies regardless of whether the conflicting laws come from legislatures, courts, administrative agencies, or constitutions.

    In April 2013, the U.S. District Court in Wyoming approved a Consent Decree to settle a lawsuit by the Rock Springs Grazing Association (RSGA) against the BLM and the Department of Interior seeking the removal of these wild horses from the Wyoming checkerboard lands. It is clearly visible that the current wild horse capture is completely politically and a monetarily motivated decision and illegal under the United States Constitution (Article VI, Clause 2).

  4. Private/corporate for-profit, domestic livestock are a non-native species on public lands that compete with wildlife, including wild horses, for precious resources in the arid west. The Taylor Grazing Act provides that the Secretary “is authorized, in his discretion, to classify any lands within a grazing district, which are . . . more valuable or suitable for any other use” than grazing, including use by wild horses or burros. As made clear by the Wild Horse and Burro Act’s implementing regulations, the BLM “may close appropriate areas of the public lands to grazing use by all or a particular kind of livestock . . . if necessary to provide habitat for wild horses or burros, to implement herd management actions, or to protect wild horses or burros from disease, harassment or injury.” 43 C.F.R. § 4710.5(a)

  5. WHY Congress needs to be informed of rogue agency malfeasance and available solutions
    By now everyone is either sick of hearing about the plight of wild horses , and the rogue agencies that are liable for this catastrophe. Congress’ only concern is about MONEY..no surprise here. WE should all be informing Congress that funds and a plethora of habitat are available for ReWilding .
    Stop DOI from using BLM Budget to extract and convert a wildlife species for commercial purposes, sale and euthanasia.
    Is Congress even aware that the following petition was submitted to USFWS? http://www.all-creatures.org/alert/alert-20140611.html. Or the funding that comes from the Wildlife Restoration Act aka Pittman-Robertson Act through specifically dedicated sources such as hunting permit fees and a special federal excise tax on products used by hunters and fishermen.     Any time a new law is passed by a legislature, or a regulation is promulgated by an agency under a law, it is an exercise of the police power
    If the exercise of police power is found to be improper, then, in effect, the courts have declared the law void and unenforceable. It is difficult to find recent examples in which a court has found an exercise of police power over animals improper. Nevertheless, there are real limitations that exist and restrict the scope of the legislature’s powers.
    Generally, when testing the appropriateness of a law the court will:
    1. first decide if the law is within the allowable concern of the public health, safety and welfare. Assuming that the law deals with an appropriate topic (protection of an endangered species), then
    2. the second question is the restrictions of the law rationally related to that lawful interest (a law which sought to control beaver problems by killing all the beaver in the state, would fail this rational relationship test).
    3. Third, assuming that the topic is appropriate and that the provisions are rationally related, then the court will set aside a law as inappropriate only if it violates some constitutional right of a citizen (this can be a state constitution, but is usually the federal constitution.)

WHO STARTED THIS ROUND UP… AMERICAN PEOPLE ARE AGAINST THIS…WE ARE FOR THE MUSTANGS..
