Judge McKibben Rules in Favor of BLM Triple B Wild Horse Stampede

The Horses Lose AGAIN!!!

Reno, Nev. — Today U.S. District Court Judge Howard McKibben issued a decision in favor of the Bureau of Land Management (BLM) which allows the BLM to proceed with the Triple B gather to remove excess wild horses on Saturday, July 16.

“The BLM is pleased with the decision of the court that allows us to move forward with the Triple B gather, where the wild horse population is five times over the minimum appropriate management level,” said Amy Lueders, BLM Nevada Acting State Director.

The BLM will gather and remove approximately 1,726 excess wild horses from in and around the Triple B, Maverick-Medicine and Antelope Valley herd management areas (HMA) and the Cherry Springs Wild Horse Territory located approximately 30 miles northwest of Ely and 70 miles southeast of Elko, Nev.  Removal of the excess wild horses is necessary to prevent degradation of rangeland resources and to ensure sufficient forage and water is available for the wild horse population.

The estimated population for the entire gather area is 2,198.  The appropriate management level (AML) for the entire area is 472-889 animals. Any horses gathered above targeted removal numbers will be released back to the range so that the remaining population is within AML.

Any gathered mares released back to the range will be vaccinated with the PZP-22 (Porcine Zona Pellucida) fertility control vaccine.  Additionally, sex ratios of gathered animals to be returned to the HMAs may be adjusted to achieve an approximately 60 percent male/40 percent female ratio.

The gathered animals will be transported to the National Wild Horse and Burro Center at Palomino Valley (PVC), in Reno, Nev., Gunnison Correctional Facility in Gunnison, Utah, and the Delta Wild Horse Corrals in Delta City, Utah.  The animals will be prepared for the BLM adoption program or for long-term holding.

The Cloud Foundation, Craig Downer and Lorna Moffat filed a lawsuit on Wednesday, June 29, 2011, and moved to enjoin the Triple B gather. Judge McKibben held a hearing Thursday morning and denied the motion to enjoin the gather.

  5. I just don’t understand. BLM is obviously breaking the law. Ms. Fazio brought up very good points and examples of how they are doing this. On what grounds did the judge rule in favor of BLM? Not another “emergency” surely. This is just so unfair. Basically, BLM continues to break the law and there isn’t a bloomin’ thing we can do to stop it. Why is that always the case?

Answer: It is because the BLM manages our land for the resources … and to them the wild ones are NOT a resource and the sooner they can remove the wild ones from what they consider to be “their land” … the faster they can exploit the land for what they consider to be resources … gas, oil, mining, livestock and water.

        IMO, when the HMAs were “chosen”, they were considered land with the least promise of resources, especially for extraction. They were also the least accessible, which meant development costs outweighed potential profits. Now that new identification and extraction techniques have been perfected, and there’s an increasing demand for not only gold, silver, and oil and gas, but also solar installations, wind farms, geothermal sites, mining of minerals like Lithium and “rare earths” (used for batteries in hybrid and electric vehicles), roadways to service developments, and right-of-ways for pipelines and transmission corridors, priorities for “multiple use” have radically changed. “Fracking” has reared its ugly head and has the potential of ruining everything it touches!

        Political pressures to both lease and SELL more of OUR public lands have increased exponentially to address our energy “wants” (not always “needs!), balance of payments and national debt.

        The HAs, which constitute nearly as much land as the HMAs in many areas where they are still identified, were more accessible and, consequently, more valuable in terms of cost/benefit. And if you look at the topography of many HAs, they’re often valleys with accessible ground water, increasing their value for livestock grazing.

        Many HAs once connected HMAs. By choosing not to manage them for wild horses and burros, the BLM created “islands” that are equivalent to Indian reservations. When the wild ones go “off reservation”, they’re subject to immediate removal and disposal by whatever means the BLM/FS/state chooses, usually public auction. Since wild horses aren’t identified as originating on an HMA until they bear a freezebrand, they’re pretty much fair game to be taken by anyone for any purpose, including slaughter. No records? No problem!

        Then there’s the USFS. They operate under a totally different set of priorities, which rarely includes retaining wild horses and burros. Whatever “protections” they do afford are more of a courtesy than a policy. They’ve been increasingly pressured by environmentalists to remove species that compete with “wildlife” they value, including the wild ones.

        Hunters want top-tier predators killed wherever they’re found, and states support their position, because of revenues generated from hunting permits. The fact that less than 20% of hunters actually get a kill has resulted in a population explosion among some big game species. Elk, which can be extremely destructive to both public and private lands, are such a problem in Colorado the state is offering tremendous incentives for hunters to come and thin the herds. If Colorado elk continue to increase at their present rate, the state says a “cull” is inevitable.

        Then there’s the “off-roaders” (including snowmobilers). They rejoiced when Obama’s half-hearted efforts to “protect” public lands failed. They also destroy about 1000 acres of land – public and private – a day. On public lands,they’re supposed to stay on designated roads, but who’s minding THAT store? It’s much more fun to go exploring! Many of the “impacts” attributed to wild horses are the same as those caused by “off-roading” (in all seasons), and should be included every EA.

        Also. the antiquated “checkerboard” system – originally established in the 1800’s for railroad expansion – is another impact on the free movement of wild horses within the HMAs, and should be investigated.

  8. Good heavens–does not the condition of the range mean a thing? Having just been through Elko Mon night/Tues morning and turning off at Wells I saw tons of snow on the peaks STILL.

    I am stunned and very upset with this news.

    I want to starts new category of folks. We have carnivores and we vegetarians and vegans. What about us folk who eat chicken but no longer red meat? I’m certain I’m not alone in this category of folk. Yes, I use milk and heavy cream for homemade ice cream. I guess its time to either use popsicles or go with almond milk for ice-cream.

    I’ve had it. No more red meat EVER AGAIN. And as for the older solid gold studsin my ears–no fancy smancy earrings or rings EVER AGAIN.

    Hopefully next year Madeleine’s Sanctuary will be ready for over nighters. Then I can kiss Elko goodbye–and NEVER stay there again. Their loss–not mine.

    I am just sick with thought that these morons (I have a new saying for BLM–Bureau of ILLEGAL MORONS) are going to run horses in the heat. Tues morning at about 7:15 it was 63 degrees. That’s A M. Antelope was just rounded up in the dead of winter and now whatever’s left will yet be run again only this time in the middle of the summer. And let us not forget that even one of the horses who ran in the Derby–his birthday was JUNE 15.

    I guess I have to leave it to RT to say the 4 letter words that would ban me. Just know I am thinking them along with the rest of you. And ICKY does’t even veto to describe how angry I am right now.

THey are all corrupt and getting monies, I’m sure, under the table from the damn cattlemen, mining industries and such. We need to get all the animal loving millionaires to back a major finance program, starting with the biggest and damnest lawsuit ever started, We need to find these people to buy land right and left to start putting all these horses on it , cleaning out the corrals the BLM has and all the horses that they will inflict their punishment on. We need to have help at the auctions to sell all our horses to us to put in these rescues we’ve started, thereby putting all the damn killer buyers out of business. We need to guard all roadways heading to Canada and Mexico to stop any trailers we might have missed previously. Any horse advocate that does not have to work to make a living could do this with legal help behind him. Maybe we then would get satisfaction when the damn killer buyers are starving to death right and left because they can’t find horses and donkeys to kill. If we don’t start doing major things to help these beautiful horses, we will not have them for our future generations. THey will be a thing of the past — never to see again. Our dear President was doing a televised press conference for no telling how long today about the deficit and talking about cuts to things that matter to the people of this country… meanwhile the Obama administration’s BLM are doing unscheduled roundups and fighting in court to continue the destruction of our Nation’s protected wildlife, ALL at extensive and continued tax payer’s expense.

    Millions upon millions of our dollars being used for unlawful destruction and actions against the will of the citizens of this country, and completely against our law protecting our wild horses and burros, while our President cries about Congress…. this is in HIS ballpark and HE IS RESPONSIBLE for this waste of our money, of lives, of freedom, and the faith of the American people!

    My mind has been in a place close to yours. Having lived in Atlanta for years, I lived and worked with people whose lives had been dramatically changed by the Civil Rights Movement. Yet the West is so big and some of us live on the East Coast, so where and when could we have a demonstration or a sit in. When I was in DC I took notice this past winter, I noticed that the Department of Interior is on one of the main roads into the Capitol/White House Area of DC. You could have a sit-in or protest march in that area without creating a great deal of havoc. I have also wondered if those of us who live in or near cities with federal court houses should try to find each other and gather. However, unless we have some kind of significant turnout and some clever signs, we are just spinning our wheels.

    Ironically, it is against the law for citizens to remove wild horses from the range. The government is supposed to be protecting them from us, but it is the government that is destroying them.

    I believe Louie is absolutely correct in terms of educating East Coast legislators. My experience has been that the Congressmen and women from the state where I live are very uninformed about the BLM and what is going on in the West, but they have been willing to listen and learn. There have been willing to listen and learn. There are some herds of wild horses up and down the East Coast.

      • I did it then … and am willing now. But PEACEFUL demonstrations are much more effective. Our numbers speak the loudest. The sheer numbers of people get the publicity. I wonder, just how many are actually willing though to commit, though? A small showing does NO good. I have no problem even getting arrested, if it will help serve to preserve our Wild Herds from extinction. In large enough numbers, the logistics are in our favor. And it. WOULD get National attention … QUICKLY. We do not need to demonstrate in DC necessarily … but at individual roundups … IMHO.

I would bet that 2198 is a random number pulled out of the ass of the blm as a means to extinguish wild horses from the Nevada landscape. Will TCF appeal to higher court and demand justice, protection, fair forage allocation for wildlife instead of invasive species? No.
