Dept. of Justice refuses to take any action against Spur Livestock, BLM contractors who sold wild horses to kill buyer

In this case, there was NO justice.  Wild Horse Freedom Federation did an investigation and found that a BLM long term holding contractor, Spur Livestock, sold wild horses to well known kill buyer Joe Simon.  R.T. Fitch, President of Wild Horse Freedom Federation, publicly presented an official government document with proof of this to the National Wild Horse & Burro Advisory Board at their meeting.  Joan Guilfoyle, Division Chief of the BLM’s Wild Horse & Burro Program, was present.

However, the Department of Justice (DoJ) only issued a letter of declination.  A declination decision is generally viewed to mean that the DoJ , in the exercise of its prosecutorial discretion, declines to prosecute or bring an enforcement action.  

So, the issue of a current BLM contractor selling wild horses to a kill buyer, most likely for slaughter, was just swept under the rug.

Also, the 36 horses with the U freezemark were BLM sale authority horses. So, Spur Livestock sold 70 wild horses to well known kill buyer Joe Simon.

 

On the BLM FROM THE PUBLIC page for the National Wild Horse & Burro Program, it states this:

Question:  What is the BLM’s response to allegations regarding wild horse sales to a South Dakota long-term pasture contractor, known as Spur Livestock, in 2008? (Updated September 2014)

Answer: The BLM cares deeply about the well-being of wild horses and burros, both on and off the range, and takes seriously all accusations of the slaughter of wild horses or burros.  These accusations were thoroughly investigated and the case was presented ot the U. S. Department of Justice who issued a letter of declination. The case has been closed.”
But, this contradicts the BLM’s answer to the question about the 1700 wild horses sold to Tom Davis (see below), in which the BLM states “Anybody that is found to have violated the 1971 Wild Free-Roaming Horses and Burros Act should be held accountable.”
In fact, Spur Livestock, owned by Jim Reeves and Lyle Anderson, continues to be under contract with the BLM.   It seems that the only thing the BLM cares deeply about is covering up the actions of its corrupt Wild Horse & Burro Program.
In furthering proof of BLM’s lack of transparency, the BLM didn’t post the actual declination letter so that the public could read the details.  The BLM Wild Horse & Burro Program should provide the public with information on all cases that it has brought to the attention of the DoJ, noting the reasons not to investigate or pursue prosecution, along with the rationale for those decisions.
As many of you know, the Department of Justice represents and defends the Bureau of Land Management in courts when wild horse advocacy groups and advocates file lawsuits against the BLM for it’s actions.
And, we’re all still sitting on the edge of our seats waiting for the answer to this question:
Question:  What is the BLM’s reaction to allegations regarding horse sales to Tom Davis of Colorado, as reported by Pro Publica?
Answer: The BLM condemns any sale of wild horses for slaughter.  We care deeply about the well-being of wild horses, both on and off the range, and it has been (and remains) the policy of the BLM not to sell or send wild horses or burros to slaughter.  We take seriously all accusations of the slaughter of wild horses or burros.  The Office of the Inspector General at the Department of the Interior has initiated an investigation into the situation and will work in conjunction with the State of Colorado throughout its investigation.  We look forward to the results of that inquiry.  Anybody that is found to have violated the 1971 Wild Free-Roaming Horses and Burros Act should be held accountable.”
Anyone who violates the 1971 Wild Free-Roaming Horses and Burros Act should absolutely be held accountable.  But they aren’t, and the BLM continues to spin public opinion with propaganda.

  1. I think that we the people should show that we do not like their misconduct of the wild horses and burros then set the wild horses and burros free that can still have a normal life…The geldings should be put up for adoption so that they can still have a good life !

    That means that they have a whole body of written text ready to respond as their rationalization for their continued war on wild horses. They claim that they care deeply about the well-being of wild horses and burros?? So selling them to kill buyers, running them down while conduction airborne round-ups, separating families, penning in small areas indefinitely, and permanently removing them from the wild lands in which they live – this demonstrates the extent of BLM’s caring.

    With caring friends like the BLM, no one needs more.

  3. I’d really like to know how to go about removing these anti-wild horse people in positions within the BLM, the DOJ, the OIG and the Department of the Interior. It’s obvious they are burned out and no longer able to do their jobs effectively (or legally). What the hell good is having laws if every flippin’ government agency can ignore them with impunity? Oh that’s right, it’s because they police themselves and are all in it together. The average American citizen, our environment and all wildlife have no chance against the good ole’ boy network that is our government. There should never have been cattle grazing allowed on HMAs, or oil/gas exploration or mining or hunting.

    • Vickie I totally agree with what YOU STATED here YOU are sooooooo right what good is our government anymore all they do is destroy these wild innocent free roaming horses and they will be the TRUE CAUSE of them becoming extinct soon so darn sad AND I”m ahsamed to say that OUR AMERICAN government is allowing this stuff to continue on and on soon so many MORE ANIMALS will become extinct, wolves ,etc and many others to mention I can list many more animals that AMERICA should be protecting.

Maybe USA Today might be interested in an ongoing legal battle we are having over everything with the wild horses and burros…and the BLM…it shows a pattern of behavior that is really questionable..Americans might be educated a little more..none of us likes a bully…and a liar… Thank you as always for your great coverage of everything for the wild ones…

  5. Has the BLM EVER prosecuted anyone for crimes against wild horses and burros? I’m mainly asking about horses sold to buyers who take them to slaughter…however ya never hear of anyone getting prosecuted for breaking the 1971 wild horse/burro act….

  6. BLM keeps things hidden but from what I have found, Spur Livestock (also known as Anderson Const.) has two long-term holding facilities for our wild ones that BLM has contracted with – Mission Ridge and Whitehorse, both in South Dakota with a combined capacity of 1,400 wild horses.

    Per FOIA documents of the Twin Peaks and the Calico BLM wild horse captures of 2010, at least 38 of these ALL DIED ON THE SAME DAY. Of course these and many others were actually sold – as Ms. Coffey proved with the documents.

    Then add in other wild horses from other HMAs that were shipped to Mission Ridge/Whitehorse that must have “died” that I do not have data on but I have no doubt that there were many others that were sold and reported as “died” and this has been going on for years. Our wild ones are sent to BLM approved holding facilities where they are sold by the truckload and then the facility owner just notifies the BLM that they have died and BLM sends them more and on and on – very convenient for BLM and profitable for the facility owners and absolutely deadly for our wild ones.

    If anyone believes that BLM sends our wild horses to facilities to live out their lives in a pleasant retirement pasture – then they are only fooling themselves. BLM has been doing this “disappearance act” with our wild ones for many years and don’t fool yourself that the top of the pile BLM employees don’t know what happens because it is thanks to them and their facilitation of these disappearances that it happens at all. Why doesn’t the Department of Justice file charges against the BLM for these illegal activities? Because the majority of the BLM Wild Horse and Burro program employees would all be in prison … from wranglers clear on up to the highest paid executives.

    This is not the first time that the Department of Justice has “hushed up” BLM’s illegal activities. See: Martha Mendoza published in 1997,Trail’s End for Horses: Slaughter, over 200 BLM employees were cited as adopting wild horses and burros with most unaccounted for and some employees acknowledging they were sent to slaughter while Pascal Derde, the proprietor of Cavel West Slaughterhouse in Redmond, OR, reportedly “displayed a sheaf of BLM certificates for horses he recently butchered”. Mendoza got some eye-popping quotes, too. “Asked about the AP’s findings,” she wrote, “Tom Pogacnik, director of the BLM’s $16-million-a-year Wild Horse and Burro Program, conceded that about 90% of the horses rounded up go to slaughter.”

  10. Does anyone really believe there are 50,000 horses in holding pens or kept on ranches in the US? They have been shipping these horses to slaughter on a regular basis by not branding them so they couldn’t be identified as being rounded up by the BLM or where they came from. Several years ago there was packages of horse meat that was seen in a stores in Europe that had pictures of horses grazing in green pastures with the caption wild horses grass fed. That was on the wrapping. Has anyone ever been allowed to watch the freeze branding? I doubt it, has anyone followed the trucks leaving one of the roundups to see just where they go? If that could have been done with photos taken you would have proof as to what happened to the horses. I suspect the drivers of the trucks helping to load the horses after a roundup are kill buyers that drive directly to which ever border they are closest too where their meat contract is located. This may happen only when the horses are shipped off to the holding pens so the BLM can protect themselves, it could go either way. Animal Angels follows trucks all the time to their destination even into Mexico, that’s how they have been able to prove what happens to horses shipped to the slaughter plants and how they are treated on the way there.

Perhaps with repeated embarrassment by showing these facts to the media, and once the general public is made aware of just what goes by with these vile kill buyers and how the government ignores laws to protect horses, people will reflect their disgust in the voting booths, and something will be done.

    • So if the BLM is outright lying about their knowledge of the wild horses being sent to slaughter, or is turning a blind eye to this when presented with the evidence, does this not make them an accomplice to a crime? Sure would be nice to see these heartless, greedy bastards (and bitches as the case may be) prosecuted for their role in the destruction of this American icon that is supposed to be protected by the 1971 Wild Horse and Burro Act. Last I heard having knowledge of a crime being committed and doing nothing about it makes you complicit in that crime.

      • Yes , fraud in the fact that they are taking money from the government on false pretenses of upholding the Wild Horse and Burro Act. Deception in that they try to deceive the public into thinking that the horses are overpopulated and starving on the range. Scam in selling horses to individuals that they know are going to hold them for the specified time and then sell them to slaughter. Scheming with the welfare ranchers and other special interests to take over more and more of the public lands ranges. Apparently we left out Collusion which is the secret or illegal cooperation or conspiracy, especially in order to cheat or deceive others. Were these the actions of any ordinary American citizen, that person would be prosecuted and most likely jailed. Apparently the Dept. of Justice is also complicit in knowing that a crime is being committed without doing anything about it; or would the word be conspiracy. Whatever the correct term, our wild equines are paying for these crimes of the government with their lives. This is a disgrace to the United States and is just more evidence to the world that the United States can be bought.

  18. Can someone please shed some light on “Letter of Declination”?

    I did find this:
    Federal declinations shall be in writing setting forth the facts of the case and the reasons for declination. Copies of approved declination memos will be provided to the FBI.
    Declinations: A declination is a decision by a United States Attorney’s Office (USAO) not
    to pursue criminal prosecution of a referral from a law enforcement agency. The fact that a USAO has received a referral does not mean that a prosecutable case exists. Cases that are originally declined may be reopened at a later date and successfully prosecuted.
    When the United States Attorney chooses not to prosecute a particular case, this is called declination.
    An Assistant United States Attorney (AUSA) has the discretion to decline to prosecute a case based on several considerations, some of which the AUSA may not be able to discuss with you.

    This brings me to another question: Did the US Attorney choose NOT to prosecute because prosecution would involve a LARGE number of BLM employees and their methods of “disposal” of our wild horses and burros???

PERSONALLY,.I FEEL CONGRESS OR THE PRESIDENT SHOULD SHUT DOWN FOREVER THE DOJ, DOI, AND ESPECIALLY THE BLM, RECIND ALL GRAZING PERMITS AND HUGE GOV.SUBSIDIES CHECKS THAT—-AMERICA’S BILLIONAIRE WELFARE RANCHERS ARE NOW RECEIVING AND RETURN ALL WILD HORSE AND MUSTANGS TO THEIR FREE PUBLIC LAND. THEY ARE GOOD FOR OUR ECOSYSTEM AND THEY HELP PREVENT FOREST FIRES, TOO. THE CATTLE,BISON AND ESPECIALLY THE SHEEP DESTROY THE LAND,CAUSE FOREST FIRES AND ARE BAD FOR AMERICA’S ECOSYTEM.
